Fired Worker Sues Arch Coal, Alleging Disability Discrimination

August 10, 2019 - A man is suing Arch Coal, alleging wrongful termination.

Jonathon Gaither was employed by the defendant from April 2014 until January 2019. During his employment, he alleges he was harassed by his supervisor due to his Irritable Bowel Syndrome and his need for accommodation, according to a complaint filed in Taylor Circuit Court and removed to U.S. District Court for the Northern District of West Virginia.

Gaither claims he was wrongfully terminated for "sleeping on the job," which he alleges is a pretext for terminating him for disability discrimination.

The defendant's actions were malicious and caused Gaither damages, according to the lawsuit.

Gaither is seeking compensatory and punitive damages. He is represented by Jeremy Donham of Donham Law.
